Orphan works can prevent the culturally desirable use of pre-existing content. This work treats the problem in a fundamental way. It describes the international developments and different approaches to solving the problem. Specifically, it discusses, how the German regulation (ยงยง 61 ff. UrhG) not only allows the better use of pre-existing content, but also how it makes it possible to influence copyright practice.
