| Summary, etc. | A new edition of Rafael de Ureña y Smenjaud's (1852-1930) admission speech to the Real Academia de Ciencias Morales y Políticas (1912). "Una tradición jurídica española" studied the local charters or fueros of the Castilian-Aragonese Extremadura that consecrated the power over the children as a "joint and solidary" power of both the father and the mother; a legal rule in open contrast, according to the speaker, with the "Roman" solution of the criticized Spanish Civil Code. Based on the argument and the sources addressed in the speech, Carlos Petit's study examines Ureña's position in Spanish legal historiography, a speciality constituted as a discipline around his contemporary Eduardo de Hinojosa y Naveros (1852-1919), archivist and medievalist and mentor to some of the founders of the influential Anuario de Historia del Derecho Español (1924). To this end, the study recovers some unpublished documents as well as several memories that illustrate the particulars of the aforementioned journal.---Se reproduce el discurso de ingreso de Rafael de Ureña y Smenjaud (1852-1930) en la Real Academia de Ciencias Morales y Políticas (1912). “Una tradición jurídica española” estudiaba los fueros de la Extremadura castellano-aragonesa que consagraron la potestad sobre los hijos como el poder “conjunto y solidario” del padre y de la madre, lo que Ureña presentó en abierto contraste con la solución “romana” (esto es, no o poco ‘española’) del criticado Código civil. El estudio de Carlos Petit examina, a partir del argumento y de las fuentes abordados en el discurso, la posición de Ureña en la historiografía jurídica española, una especialidad constituida como disciplina en torno a Eduardo de Hinojosa y Naveros (1852-1919), archivero y medievalista y maestro de algunos de los fundadores del influyente Anuario de Historia del Derecho Español (1924). A ese fin se recuperan algunos documentos inéditos y varios recuerdos que ilustran los particulares de la revista indicada. |
